New 403(b)/Tax Deferred Annuity RegulationsMinsink Valley employees who have 403(b) accounts recently received notification regarding a temporary freeze on exchanges, or movement, of their savings from one investment provider to another, or from one investment contract to another contract even if administered by the same investment provider. The following information is provided to further explain the basis for our action at this time. New regulations governing 403(b) accounts were recently issued. Most of the new provisions impact how employers will need to administer these plans. We anticipate that operational procedures will be issued over the coming months to assist us in ensuring that employees’ 403(b) accounts are in accordance with IRS regulations and continue to be tax deferred. We have been specifically notified of one particular change, however, that creates new parameters regarding an employee’s option to move existing investments from their current investment provider to a new provider. This regulation also applies to the movement of savings from a current investment contract to a new contract, even if both contracts are held by the same investment provider. While the implementation date for the regulation affecting such exchanges is January 1, 2009, it will retroactively apply to investment contract/account exchanges completed after September 24, 2007. To ensure IRS compliance and to safeguard your investments, we have elected to follow the most current recommendations of the IRS: The IRS has advised school districts to impose a temporary freeze, effective immediately, on pre-distribution investment contract/account exchanges and that they notify their employees of this temporary freeze as soon as possible. This temporary freeze will provide time for clarification of the legal and practical implications of this new regulation. We will keep you informed of any and all changes that affect your 403(b) investment rights and options.
